Services and Support
- Provision of Services: Treegress commits to providing its QA automation tools and services using commercially reasonable efforts and according to the service specifications listed on our website. Upon registration, you will define an administrative username and password for your account management.
Usage Restrictions and Responsibilities
- Usage Restrictions: You agree not to reverse engineer, decompile, disassemble, or otherwise attempt to discover the underlying code of our services. The creation of derivative works, misuse of the services, or use for the benefit of a third party in a manner that is not authorized by Treegress is prohibited.
- Legal Compliance: You must use the services in compliance with all applicable laws and regulations. You are also responsible for securing any necessary equipment and services to use our platform. Treegress reserves the right to monitor use and to suspend service for non-compliance.
Confidentiality and Intellectual Property
- Confidentiality: Each party acknowledges that it may be exposed to confidential and proprietary information from the other party. Both parties agree to protect such information and use it only to fulfill their obligations under these terms.
- Ownership: You retain all rights to your data. Treegress retains all rights to its services, including any developments or derivatives thereof.
Payments
- Fees: You agree to pay the fees set forth for using Treegress services as detailed on our website or as agreed in written form. Treegress may adjust these fees with prior notification.
Term and Termination
- Term: These terms are effective upon your use of the services and continue until terminated by either party. Treegress may terminate the agreement immediately upon breach of these terms by the customer.
- Survival: Provisions regarding confidentiality, payments, and liability survive the termination of these terms.
Warranties and Disclaimers
- Service Level: Treegress does not guarantee that the services will be uninterrupted or error-free. The services are provided "as is" and as available.
Limitation of Liability
- Liability Cap: Treegress’s liability under these terms shall not exceed the fees you paid to Treegress in the 12 months preceding any claim. Treegress is not liable for indirect, special, incidental, or consequential damages.
General Provisions
- Governing Law: These terms are governed by the laws of the state where Treegress is headquartered, without regard to its conflict of laws provisions.
- Entire Agreement: These terms constitute the entire agreement between you and Treegress regarding its subject matter and supersede all prior agreements and understandings, whether written or oral.
